New APSCo service brings reassurance to recruiters.

Contract help.

The Association of Professional Staffing Companies (APSCo) – in conjunction with JMW Solicitors LLP and The Contract Doctor – has launched an updated written contract review service in order to better support members in reducing liability through operational best practice.

Through the system – which aims to have a 48 hour turnaround time – members can receive a written risk assessment of client terms, which provides clarity on the obligations, risks and liabilities included within the contract. The service is designed to assist businesses either before a contract is signed, if deciding on accepting terms, or after, if they are seeking to audit existing liabilities. Fees for this service are variable depending on the experience of the reviewer, whether the provider is a regulated law firm with associated benefits, and the length of the terms.

On the launch, Tania Bowers, General Counsel at The Association of Professional Staffing Companies (APSCo), commented: “APSCo is always striving to enhance its service offering for members, and we are delighted that JMW and The Contract Doctor are partnering with us on this latest initiative. In today’s increasingly legislative environment, compliance and risk management are key focus areas for all of our members, regardless of size, sector or geography. Business leaders are seeking a written audit trail and need to measure the contract risk across their business, for their insurers, auditors and potential investors.

“We’re delighted to be working with APSCo in the delivery of this important service for its members at what is clearly an important time, with the proposed changes to IR35 in the private sector and the impact of Brexit,” commented Richard Parkinson, Partner at JMW Solicitors LLP. “We’re delighted to be working with APSCo in the delivery of this important service for its members at what is clearly an important time, with the proposed changes to IR35 in the private sector and the impact of Brexit. It’s vital for businesses to understand their rights and obligations in contracts before entering into them. The service will not only allow APSCo members to identify risks in contracts proposed by their clients – allowing them to develop strategies to minimise the effects of such risk, whether that be a renegotiation of terms or putting in place internal processes and structures – but also to ensure they know what rights the contract gives them so that they can manage it to their benefit.”

Helen Phillips, Director at The Contract Doctor concluded: “Risk assessment is incredibly important for recruitment companies, not just for their day to day working but for longer term investment opportunities.  The APSCo document review service makes a risk assessment much more affordable and easy to access and we are delighted to be involved.”
