In April 2017, the government introduced the ‘Off-payroll working rules in the Public Sector’ legislation. This required the public-sector body (the hirer) to assess the employment status of all their workers engaged through a Personal Service Company (PSC), including those supplied via an agency. Similar legislation will come into effect for the Private Sector in April 2020 for medium and large companies.
The proposed changes will have the following implications:
- The PSC will no longer decide on IR35 status – the responsibility will shift to the end hirer who must take reasonable care
- The Agency and the Fee Payer (if not the agency)Â will be need to assess if reasonable care has been taken in reaching the decision and if inside IR35, they are responsible for PAYE calculations and payment to HMRC.
